User Agreement of the Ritiko.by website

1. Procedure for concluding the Agreement

1.1. This User Agreement (hereinafter — the Agreement) is concluded between the limited liability company "Sivur" (UNP 193667988, location: 220004, Minsk, 25 Kalvariyskaya Street, office 200) (hereinafter — Sivur LLC), the owner of the website located at https://ritiko.by (hereinafter — the Website), and a user of the Website, jointly referred to as "the Parties".

1.2. This Agreement determines the procedure for using the Website, establishes the mutual rights and obligations of the Parties, is a public offer and may be accepted only by adhering to it in its entirety (Articles 396, 398 and 407 of the Civil Code of the Republic of Belarus).

1.3. By starting to use the Website (any of its sections or features) and by completing registration on the Website, the User expresses their unconditional agreement to all terms of the Agreement and undertakes to comply with them or to stop using the Website. Accepting the Agreement on other terms or subject to conditions is not allowed.

2. General provisions

2.1. The User's use of the Website is governed by this Agreement and by:

2.1.1. the Personal Data Processing Policy of Sivur LLC (hereinafter — the Personal Data Policy);
2.1.2. the Cookie Policy;
2.1.3. the terms of sale, rental (hire) of products, tailoring and alterations contracts concluded between the User and Sivur LLC (hereinafter — the Contracts);
2.1.4. other documents published on the Website in open access.

2.2. By concluding the Agreement the User confirms that they have reached the age established by the legislation of the Republic of Belarus for entering into the legal relations provided for by the Agreement and have no restrictions preventing them from concluding the Agreement.

2.3. If the User does not agree with the Agreement in its entirety or with any of its parts, the User must immediately stop using the Website.

2.4. Sivur LLC may amend and supplement the Agreement at any time. A new version takes effect from the moment it is published on the Website. Continuing to use the Website after a new version is published means that the User accepts the amendments made.

3. Terms and definitions

3.1. The following terms are used in the Agreement:

Authorisation — the procedure for granting the User access to the account area after Authentication.
Authentication — the procedure for verifying the User when they sign in to the account area by entering their e-mail address (phone number) and password.
Order — a request to purchase or hire a product, or to have tailoring or alterations performed, placed by the User with the help of the Website's features (the shopping cart) or by other means.
Account area — the personal section of the Website, unavailable to third parties, which displays information about the User and their order history and allows the User to amend their data and interact with Sivur LLC.
User — a natural person who uses the Website, including one who has an account area.
Website — the internet resource of Sivur LLC and its components combined by the single address space of the ritiko.by domain name.

3.2. Other terms are used as defined by the legislation of the Republic of Belarus.

4. Subject of the Agreement

4.1. The subject of the Agreement is providing the User with access to the Website and its features.

4.2. The Website provides the User with the following opportunities:

viewing the catalogue of wedding and evening dresses, accessories and other products, and information about rental (hire), tailoring and alterations services;
registering and using the account area;
placing an Order using the shopping cart;
booking a fitting in the salon;
sending enquiries to Sivur LLC, including through Website forms and the messengers indicated on the Website;
viewing blog materials, contact details, and payment and delivery methods.

4.3. The right to use the Website to the extent established by the Agreement is granted to the User free of charge. Individual features of the Website may be unavailable until the User registers and (or) completes Authorisation.

4.4. The Agreement does not regulate the procedure for selling goods, hiring out products or providing services, their price or the procedure for payment. Those terms are established by the Contracts. Information about products and services published on the Website is for information purposes only and is not a public offer. An Order placed by the User is treated as the User's offer to conclude a Contract; a Contract is deemed concluded from the moment Sivur LLC confirms the Order (by phone, e-mail or in a messenger) or otherwise as the Contract provides.

5. Rights and obligations of the parties

5.1. The User is entitled to:

use the Website and its features in accordance with their purpose;
register an account area, place Orders and book fittings;
interact with Sivur LLC using the Website's features and the means of communication indicated on it;
delete their account area in the procedure established by the Agreement;
exercise other rights provided for by the Agreement and legislation.

5.2. The User must:

use the Website's features in good faith and in accordance with their direct purpose;
comply with the restrictions established by section 9 of the Agreement;
provide accurate and complete information about themselves when registering and placing an Order, and keep it up to date;
not disclose their account area password to third parties;
immediately notify Sivur LLC of any case of unauthorised access to the account area.

5.3. Sivur LLC is entitled to:

use the User's data obtained in accordance with the Agreement in order to perform it;
change the Website and its features at any time, suspend the Website's operation with or without prior notice to users;
send the User service (technical) messages about the operation of the Website and the account area, the status of an Order, and amendments to the Agreement;
delete a User's account area in the cases provided for by the Agreement;
exercise other rights provided for by the Agreement and legislation.

5.4. Sivur LLC must:

ensure the User the opportunity to use the Website to the extent provided for by the Agreement;
consider enquiries from users received through the Website's features;
take the necessary legal, organisational and technical measures to protect the data provided by the User when the Website is used.

6. Registration and deletion of the account area

6.1. The account area is registered by the User by filling in the registration form on the Website (surname, first name, phone number, e-mail address, password) and adhering to the Agreement.

6.2. Once registration is complete, a unique user account is created. A password is restored through the "Forgotten password?" link by sending instructions to the User's e-mail address.

6.3. All actions performed in the account area after Authorisation using the User's credentials are deemed to have been performed by that User.

6.4. Deleting the account area results in the deletion of its informational content without the possibility of restoration. Order details are retained by Sivur LLC for the periods established by legislation and by the Personal Data Policy.

6.5. The account area is deleted:

upon the User's request sent to the e-mail address ritiko.by@yandex.by from the address given during registration, or by a written application sent to the postal address: 220079, Minsk, P.O. Box 147;
at Sivur LLC's initiative — if the User breaches the Agreement, or if three years have passed since the User's last Authorisation.

7. Features of the account area

7.1. In the account area the User may amend their personal details and password, and view their order history and Order statuses.

7.2. Signing out of the account area ends the current session and does not result in the account area being deleted.

8. Processing of personal data

8.1. Sivur LLC processes the personal data of users obtained when the Agreement is concluded and performed, for the purposes of carrying out the actions established by the Agreement (the fifteenth paragraph of Article 6 of the Law of the Republic of Belarus of 7 May 2021 No. 99-Z "On Personal Data Protection"), namely to provide the User with access to the Website and the account area and to process Orders.

8.2. Other matters concerning the processing of personal data, the User's rights as a personal data subject and the procedure for exercising them are determined by the Personal Data Policy published on the Website.

8.3. Sivur LLC uses cookies to operate the Website. Necessary cookies are processed in order to perform the Agreement; other (targeted) cookies are used only with the User's consent in the procedure established by the Cookie Policy.

9. Restrictions on use of the Website

9.1. When using the Website the User is not entitled to:

post and (or) disseminate information whose dissemination is prohibited or restricted by legislative acts;
infringe the rights of third parties and (or) cause them harm;
interfere with the operation of the Website, take actions aimed at disrupting its operation and security, including using automated means of collecting information;
place Orders without the intention of concluding a Contract, or provide knowingly false data;
use the Website's Materials in breach of section 10 of the Agreement.

10. Intellectual property

10.1. All objects published on the Website, including design elements, texts, photographs and images of products, sketches and clothing models, and the designation "Ritiko" (hereinafter — the Materials), are the exclusive property of Sivur LLC and (or) other rights holders.

10.2. The Materials may be used only within the Website's features. Copying, reproducing, disseminating or adapting the Materials, including manufacturing products based on the models published on the Website, without the prior written consent of the rights holder is prohibited.

11. Liability

11.1. Sivur LLC does not guarantee uninterrupted and error-free operation of the Website and is not liable for the inability to access it for reasons beyond its control (communication line failures, equipment faults, actions of internet service providers, etc.).

11.2. Images of products on the Website may differ slightly from the products in colour shade depending on the settings of the User's device screen.

11.3. Sivur LLC is not liable for losses incurred by the User as a result of unauthorised access to their account area caused by the User's failure to keep their password confidential.

11.4. The Website may contain links to third-party internet resources (social networks, messengers). Sivur LLC is not liable for their availability, contents or the consequences of their use.

11.5. Sivur LLC's liability under the Contracts is determined by the Contracts and by consumer protection legislation.

12. Final provisions

12.1. The Agreement takes effect for the User from the moment they start using the Website and remains in force until the User stops using the Website or the account area is deleted.

12.2. Matters not regulated by the Agreement are governed by the legislation of the Republic of Belarus. Disputes are resolved through negotiations, and if no agreement is reached — in court in accordance with the legislation of the Republic of Belarus.

12.3. The Parties may exchange information using telephone communication, e-mail, and the messengers and social networks indicated on the Website.
